These Terms and Conditions (“Terms”) govern your access to and use of the Jaipur Gems Platform and the website jaipurgems.org (collectively, the “Platform”), operated by Jaipur Gems (“we,” “us,” “our”), including any purchases you make and any communications you have with us, including via WhatsApp.

By accessing or using the Platform, placing an order, or messaging us on WhatsApp, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

You must be at least 18 years old, or accessing the Platform under the supervision of a parent or legal guardian, to place an order. By using the Platform, you represent that you meet this requirement.

2. Products and Pricing

• All jewelry products (gold, diamond, gemstone, and other items) are described with reasonable accuracy, including metal purity (karat/fineness), gemstone certification, and hallmarking status where applicable, in compliance with BIS (Bureau of Indian Standards) hallmarking regulations.
• Prices are subject to change based on prevailing gold/precious metal rates, making charges, and applicable taxes (GST), and are confirmed at the time of order placement.
• Product images are for representation; actual products may vary slightly due to the handcrafted nature of jewelry.
• We reserve the right to limit quantities, refuse orders, or correct pricing errors, and will notify you before processing any affected order.

3. Orders and Payment

• Placing an order constitutes an offer to purchase, which we may accept or decline (e.g., in cases of suspected fraud, pricing errors, or stock unavailability).
• Payments are processed through secure, PCI-DSS compliant third-party payment gateways. We do not store your full card details.
• For high-value orders, we may require additional identity verification consistent with applicable KYC/AML regulations.
• An order confirmation (via email, SMS, or WhatsApp) does not guarantee availability; we will notify you promptly if an item cannot be fulfilled and issue a full refund.

4. Shipping and Delivery

• We aim to ship and deliver orders within the timelines communicated at checkout or via order confirmation.
• Jewelry shipments are insured and require signature/ID verification on delivery for high-value items.
• Risk of loss passes to you upon delivery. Please inspect your order immediately upon receipt and report any discrepancy within 48 hours.

5. Returns, Exchanges, and Refunds

• Returns and exchanges are accepted within the period specified in our Returns Policy (communicated at the time of purchase), subject to the product being unused, in original condition, with tags, certification, and packaging intact.
• Customized, engraved, or made-to-order jewelry may not be eligible for return except in case of manufacturing defect.
• Refunds, where approved, will be processed to the original payment method within the timeline specified in our Returns Policy.
• Certified gemstone and diamond products must be accompanied by the original certification for any return or exchange.

6. WhatsApp Communications

• If you contact us via WhatsApp, or opt in to receive updates from us on WhatsApp, we will use that channel to send order confirmations, shipping updates, appointment reminders, and, where you have separately consented, promotional messages.
• Communications sent via WhatsApp are subject to Meta's WhatsApp Business Terms of Service in addition to these Terms.
• You may opt out of promotional WhatsApp messages at any time by replying “STOP” or contacting customer.service@jaipurgems.com. See our Privacy Policy and Data Deletion Policy for further detail.
• Do not send us sensitive personal information (e.g., full payment card numbers, passwords) via WhatsApp; we will never ask you to do so.

7. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Notify us immediately of any unauthorized use of your account.

8. Intellectual Property

All content on the Platform — including product designs, images, logos, trademarks, and text — is the property of Jaipur Gems or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use automated means (bots, scrapers) to access the Platform without our written permission.
• Submit false or misleading information when placing an order or contacting customer support.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Jaipur Gems shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or products purchased, except in cases of gross negligence, wilful misconduct, or as otherwise required by Indian consumer protection law. Our aggregate liability for any claim shall not exceed the amount paid by you for the relevant order.

Nothing in these Terms limits your statutory rights under the Consumer Protection Act, 2019 or other applicable Indian consumer protection law.

11. Warranty Disclaimer

Products are provided “as described,” with warranties limited to those explicitly stated in our product listings, certification documents, and Returns Policy. We do not provide any warranty beyond what is legally required or expressly stated at the time of sale.

12. Indemnification

You agree to indemnify and hold harmless Jaipur Gems, its officers, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Platform.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy and Data Deletion Policy, which describe how we collect, use, and protect your personal data, including data shared via WhatsApp.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India, without prejudice to any mandatory consumer protection venue rights you may have.

15. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via our website or, where appropriate, via WhatsApp/email.
